01Acceptance of these terms

These Terms of Use (“Terms”) govern your use of mentionmethod.com and any related pages we operate (the “Site”). The Site is operated by OptalX, LLC, a California limited liability company (“MentionMethod,” “we,” “us,” or “our”). By using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

If you use the Site on behalf of a company or other organization, you confirm that you have authority to accept these Terms for it.

02Our services are covered separately

These Terms cover the Site only. Our paid services, including campaign management and platform access, are provided under a separate written agreement, such as an order form or master services agreement. If these Terms conflict with that agreement, the agreement controls.

03Who may use the Site

The Site is intended for businesses and professionals. You must be at least 18 years old and able to form a binding contract to use it.

04Using the Site

Subject to these Terms, we give you a limited, non-exclusive, non-transferable, revocable permission to access and use the Site for your own business evaluation and informational purposes. We may change, suspend, or discontinue any part of the Site at any time.

05What you agree not to do

• Copy, scrape, harvest, or crawl the Site or its content by automated means, except for standard search-engine indexing.
• Use Site content to train, fine-tune, or build artificial intelligence or machine-learning models, or to build a competing product, without our written permission.
• Probe, scan, or test the vulnerability of the Site, or bypass any security or access controls.
• Interfere with the Site’s operation, including by uploading viruses or other harmful code or overloading our infrastructure.
• Submit false information, impersonate anyone, or misrepresent your affiliation with any person or company.
• Use the Site in violation of any law or the rights of others.

06Intellectual property

The Site and everything on it, including text, graphics, designs, logos, animations, and code, are owned by MentionMethod or our licensors and are protected by intellectual property laws. MentionMethod and the MentionMethod logo are our trademarks. You may not use them without our prior written permission.

ChatGPT, Gemini, Perplexity, Claude, Copilot, and other product names shown on the Site are trademarks of their respective owners. We reference them only to describe the platforms our services relate to. Their appearance does not mean those owners are affiliated with, sponsor, or endorse MentionMethod.

07Information and feedback you send us

You are responsible for the information you submit through the Site, and you confirm that you have the right to share it. Our use of personal information is described in our Privacy Policy. If you send us ideas or feedback about our products, we may use them without any obligation to you.

08Informational content and no guaranteed results

Content on the Site is provided for general information about our services and the market. It is not legal, financial, or professional advice. Statistics and research we cite come from third-party sources, which we believe to be reliable but do not independently verify.

AI assistants and large language models are built and controlled by third parties, which can change how they work at any time. We do not guarantee any particular mention, ranking, recommendation, or other result from any AI platform, search engine, or publication.

The Site may link to or include services operated by others, such as scheduling tools, forms, and external websites. We do not control and are not responsible for them, and your use of them is governed by their own terms and policies.

11Limitation of liability

To the fullest extent permitted by law, MentionMethod, OptalX, LLC, and their officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Site. Our total liability for any claim relating to the Site will not exceed one hundred U.S. dollars (US$100).

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

12Indemnification

You agree to defend, indemnify, and hold harmless MentionMethod, OptalX, LLC, and their officers, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site or your violation of these Terms.

13Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction. Before filing a claim, you agree to contact us first so we can try to resolve the issue informally.

14Changes and termination

We may update these Terms from time to time by posting a new version on this page and changing the “Last updated” date. Your continued use of the Site after changes take effect means you accept them. We may suspend or end your access to the Site at any time if we believe you have violated these Terms.

15General

These Terms, together with our Privacy Policy, are the entire agreement between you and us about the Site. If any provision is found unenforceable, the rest will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent, and we may assign them in connection with a merger, acquisition, or sale of assets.
